Crewshift Terms of Service

1. Definitions

For the purpose of these Terms, the following definitions apply:

2. General provisions

2.1 Subject matter

These Terms define rules and conditions for using Crewshift, a SaaS platform for workforce scheduling, attendance operations and labor-time control in hospitality and other shift-based industries.

2.2 Acceptance of Terms

By using the Service, you accept these Terms. If you do not accept the Terms, you may not use the Service.

2.3 Changes to Terms

The Service Provider may amend these Terms. Users will be notified at least 30 days in advance via:

  • In-platform notice
  • E-mail notification

Continued use of the Service after effective date means acceptance of updated Terms.


3. Scope of Service

3.1 Core functionalities

Crewshift enables:

  • Shift scheduling and roster management
  • Time & attendance workflows
  • Leave and absence request handling
  • Automated labor-rule risk checks
  • AI-assisted no-show risk prediction
  • Team communication on schedule changes
  • Operational reporting

3.2 Compliance disclaimer

IMPORTANT: Crewshift includes labor-rule checks (working time norms, daily/weekly rest windows and selected fair workweek-related controls depending on configuration).

These controls are informational only and:

  • Are not legal advice
  • Do not replace legal or HR consultation
  • Do not transfer legal responsibility from employer to Service Provider

The Organization remains solely responsible for legal compliance.


4. Registration and Account

4.1 Eligibility

To use the Service, the User must:

  • Be legally capable of entering into agreements
  • Have authority to act on behalf of the Organization (for admins)
  • Provide true and up-to-date registration data
  • Accept these Terms and Privacy Policy

4.2 Registration data

Required registration data:

  • E-mail address (login)
  • Full name
  • Organization name
  • Organization Tax ID (where applicable)

4.3 Account security

User is responsible for:

  • Keeping login credentials confidential
  • Immediate notification of unauthorized access
  • Actions executed through their Account

5. Subscription and Payments

5.1 Subscription plans

The Service offers the following plans:

Displayed prices are gross final amounts. Sales are provided without VAT charges by the Service Provider.

5.2 Flat-rate model

Crewshift uses a flat-rate model. There are no per-user/per-seat charges.

5.3 Billing period

  • Monthly subscription: billed in advance each month
  • Yearly subscription: billed in advance each year (equal to 10 monthly fees)

5.4 Payment processor

Payments are processed by Stripe Inc. Accepted methods depend on region and processor availability.

5.5 Trial period

Trial-Pro grants 14 days of full functionality. After trial, the Organization selects Single-Pro or Multi-Pro.

5.6 Auto-renewal

Paid subscriptions renew automatically unless cancelled according to section 9.

5.7 Price changes

Service Provider may update prices. Organizations are notified at least 60 days in advance. New prices apply from next billing cycle.


6. Acceptable use

6.1 Permitted use

The Service may be used solely for:

  • Workforce scheduling and shift management
  • Working time recording
  • Absence and leave operations
  • Team communication related to schedules
  • HR/payroll support reporting

6.2 Prohibited actions

User may not:

  • Use the Service unlawfully
  • Attempt to break, bypass or reverse-engineer security
  • Introduce malware or abuse infrastructure
  • Interfere with operation of the Service
  • Share unauthorized access credentials

6.3 Fair use and abuse prevention

Service Provider may apply technical safeguards against abuse, including temporary rate limits and protective access controls.


7. Data processing and confidentiality

7.1 Data ownership

Organization retains ownership of its operational data entered into the Service.

7.2 Data processing role

  • Organization is typically Data Controller for employee data
  • Service Provider is Data Processor under separate data processing terms

7.3 Confidentiality

Service Provider applies commercially reasonable technical and organizational safeguards to protect confidentiality, integrity and availability of data.


8. Service availability and support

8.1 Availability target

The Service is provided on a best-effort SaaS basis with planned maintenance windows communicated in advance where possible.

8.2 Support channels

Support is provided via configured channels (e-mail and in-product communication), with response priority dependent on active subscription tier.


9. Termination and cancellation

9.1 Cancellation by Organization

Organization may cancel subscription with effect at the end of current billing period.

9.2 Termination by Service Provider

Service Provider may suspend or terminate access in case of material breach, non-payment or unlawful use.

9.3 Data after termination

After termination, data retention and deletion are performed according to legal obligations and Privacy Policy.


10. Intellectual property

All rights to software, architecture, design, trademarks and documentation of the Platform remain with Service Provider or licensors.

No right is granted to copy, resell, sublicense or modify the Platform beyond permitted use.


11. Liability

11.1 Service character

The Service is provided as a professional SaaS tool. Decisions made by Organization using Service outputs remain Organization responsibility.

11.2 Limitation

To the maximum extent permitted by law, Service Provider shall not be liable for indirect, incidental, consequential or punitive damages.

11.3 Compliance responsibility

Legal compliance of schedules and labor processes remains the Organization's responsibility.


12. Governing law and jurisdiction

These Terms are governed by Polish law unless mandatory law in the User's jurisdiction provides otherwise.

Disputes shall be resolved by competent courts according to applicable law.

14. Final provisions

If any provision is found invalid, remaining provisions remain in force.
